Welcome to Collect::Grow::Show (the “Platform”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of our website and services. By accessing or using our Platform, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use the Platform.

0. Definitions

For the purposes of these Terms:

• “User” refers to any individual who accesses or uses the Platform.
• “Platform” refers to the Collect::Grow::Show website, database, tools, services, and all associated content.
• “Subscription” refers to paid access to premium features.
• “Personal Inventory” refers to user-submitted plant data that is private by default.
• “Shared Database” refers to the publicly accessible species database maintained by Collect::Grow::Show.

1. User Responsibilities

You agree to:

• Provide accurate and complete registration information.
• Maintain the confidentiality of your account credentials.
• Use the Platform in compliance with all applicable laws and these Terms.
• Be responsible for all activities conducted through your account.
• Not share your account credentials or allow others to access your account.

2. Permitted and Prohibited Use

You may use our Platform to:

• Browse and manage your plant collection.
• Access subscription tools and reports for personal, non-commercial use.

You agree not to:

• Copy, reproduce, or distribute any content or tools provided by the Platform.
• Circumvent, disable, or otherwise interfere with security features.
• Use the Platform for any unlawful, fraudulent, or harmful purpose.
• Attempt to reverse-engineer, decompile, or modify any part of the Platform.
• Use any data mining, robots, or similar data gathering methods.

3. Subscription and Payment Terms

• Access to premium tools and features is available through a subscription plan.
• All prices are displayed in ZAR Rand and are subject to change with notice.
• Subscription fees are billed on a recurring basis unless canceled.
• By subscribing, you authorize us to charge your payment method on a recurring basis.
• Refunds are subject to our Refund & Cancellation Policy.

4. Account Suspension and Termination

We reserve the right to:

• Suspend or terminate your access to the Platform without prior notice if we believe you have violated these Terms.
• Investigate any suspected breach of these Terms.
• Remove any content or information you upload that violates our policies.

If your account is terminated, you will lose access to all subscription features and associated data.

5. Intellectual Property Rights

All content on the Platform— including but not limited to text, images, tools, software, data structures, branding elements, and visual layouts— is either the property of Collect::Grow::Show, licensed from third parties, or used under applicable open content licenses.

a) Platform Content Ownership

Except where explicitly stated, all original content produced by us is protected by copyright, trademark, and other applicable intellectual property laws. You may not reuse, reproduce, republish, or redistribute any part of the Platform for commercial purposes without our prior written consent.

b) Use of External Sources and Licensed Content

Our Platform incorporates descriptive content, scientific names, images, and plant metadata from third-party sources, including but not limited to Llifle.com, community contributors, and other licensed databases.

Content sourced from Llifle.com is licensed under the Creative Commons Attribution-ShareAlike (CC-BY-SA) license.

You may reuse or adapt this content only if:

• You provide clear and accurate attribution to Llifle.com and its contributors;
• Any derivative works are shared under the same or a compatible license;
• You do not use the content for commercial purposes without obtaining explicit permission from the rights holder (e.g., Llifle.com).

Use of other third-party content is subject to the specific license or terms of those content providers. Where applicable, we strive to provide attribution and comply with the licensing terms required by those sources.

c) User-Submitted Content

Any content submitted by users (e.g., images, notes, personal plant descriptions) remains the intellectual property of the original user. By submitting content to the Platform, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, display, and distribute your content in connection with the operation and promotion of the Platform.

You are responsible for ensuring that you have the legal right to share any content you upload.

d) Restrictions and Fair Use

Except where otherwise permitted by law or applicable license (e.g., Creative Commons), you may not:

• Copy, reproduce, or distribute content without permission.
• Extract or scrape data from the Platform for reuse elsewhere.
• Use any material for external commercial use without written authorization from the respective rights holders.

e) Disputes and Content Concerns

If you believe that any content on the Platform infringes your intellectual property rights or violates the terms of a license, please contact us immediately at [email protected]. We will investigate and, where necessary, modify or remove the disputed content.

6. Acceptable Use and Content Submission

You agree to use the Platform responsibly and in accordance with these Terms. You may not use the Platform to:

• Upload or share content that is unlawful, offensive, harmful, or infringes on the rights of others
• Attempt to bypass security features or gain unauthorized access to any part of the Platform
• Distribute spam, malware, or disruptive code
• Misrepresent your identity or impersonate others
• Engage in data scraping, mining, or automated data extraction unless explicitly permitted

a) User Submissions and Privacy

You may submit content such as plant descriptions, images, notes, and collection data to the Platform. Submissions fall into two categories:

• Private Inventory Content: Content added to your personal collection remains visible to you only and is not accessible to other users.
• Shared Database Submissions: In certain cases, you may choose to contribute to the master species database. These contributions may be made visible to other users at our discretion and only where explicit consent is provided.

We do not publish any of your submissions or profile content without your express permission unless it is intended for inclusion in the shared species database.

b) Responsibility for Uploaded Content

You retain ownership of any content you submit but grant us a non-exclusive, royalty-free, worldwide license to store, display, and use that content solely to provide and improve the Platform.

You are solely responsible for ensuring that:

• Your submissions do not infringe on third-party rights
• You have the necessary permissions or licenses for any external content you upload
• Your contributions are appropriate and accurate to the best of your knowledge

We reserve the right to moderate, remove, or restrict access to any content that we believe violates these Terms or applicable laws.

7. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Errors, inaccuracies, or omissions in the content or tools provided

Use of the Platform and its content is at your own risk.

8. Disclaimers

All content, reports, and tools are provided “as is” and “as available” without warranties of any kind.

We do not warrant that:

• The Platform will always be secure, error-free, or uninterrupted
• Reports or data are complete, accurate, or suitable for any specific purpose

You are solely responsible for how you interpret and use any data or analysis provided.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of South Africa.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Johannesburg.

We reserve the right to modify or update these Terms at any time. When we do, we will revise the “Last Updated” date at the top of this page. Continued use of the Platform after any changes signifies your acceptance of the updated Terms.

11. Entire Agreement

These Terms, along with our Privacy Policy, Disclaimer, Acknowledgement of Sources, and Refund & Cancellation Policy, constitute the entire agreement between you and Collect::Grow::Show regarding your use of the Platform. They supersede any prior agreements, oral or written, relating to such use.
