3. Subscription and Payment Terms

Access to premium tools and features is available through a subscription plan.
All prices are displayed in ZAR Rand and are subject to change with notice.
Subscription fees are billed on a recurring basis unless canceled.
By subscribing, you authorize us to charge your payment method on a recurring basis.
Refunds are subject to our Refund & Cancellation Policy.

4. Account Suspension and Termination

We reserve the right to:

Suspend or terminate your access to the Platform without prior notice if we believe you have violated these Terms.
Investigate any suspected breach of these Terms.
Remove any content or information you upload that violates our policies.

If your account is terminated, you will lose access to all subscription features and associated data.

5. Intellectual Property Rights

All content on the Platform— including but not limited to text, images, tools, software, data structures, branding elements, and visual layouts— is either the property of Collect::Grow::Show, licensed from third parties, or used under applicable open content licenses.

a) Platform Content Ownership

Except where explicitly stated, all original content produced by us is protected by copyright, trademark, and other applicable intellectual property laws. You may not reuse, reproduce, republish, or redistribute any part of the Platform for commercial purposes without our prior written consent.

b) Use of External Sources and Licensed Content

Our Platform incorporates descriptive content, scientific names, images, and plant metadata from third-party sources, including but not limited to Llifle.com, community contributors, and other licensed databases.

Content sourced from Llifle.com is licensed under the Creative Commons Attribution-ShareAlike (CC-BY-SA) license.

You may reuse or adapt this content only if:

You provide clear and accurate attribution to Llifle.com and its contributors;
Any derivative works are shared under the same or a compatible license;
You do not use the content for commercial purposes without obtaining explicit permission from the rights holder (e.g., Llifle.com).

Use of other third-party content is subject to the specific license or terms of those content providers. Where applicable, we strive to provide attribution and comply with the licensing terms required by those sources.

c) User-Submitted Content

Any content submitted by users (e.g., images, notes, personal plant descriptions) remains the intellectual property of the original user. By submitting content to the Platform, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, display, and distribute your content in connection with the operation and promotion of the Platform.

Extract or scrape data from the Platform for reuse elsewhere.

Private Inventory Content: Content added to your personal collection remains visible to you only and is not accessible to other users.
Shared Database Submissions: In certain cases, you may choose to contribute to the master species database. These contributions may be made visible to other users at our discretion and only where explicit consent is provided.

We do not publish any of your submissions or profile content without your express permission unless it is intended for inclusion in the shared species database.

b) Responsibility for Uploaded Content

You retain ownership of any content you submit but grant us a non-exclusive, royalty-free, worldwide license to store, display, and use that content solely to provide and improve the Platform.

You are solely responsible for ensuring that:

Your submissions do not infringe on third-party rights
You have the necessary permissions or licenses for any external content you upload
Your contributions are appropriate and accurate to the best of your knowledge

We reserve the right to moderate, remove, or restrict access to any content that we believe violates these Terms or applicable laws.

1. General Refund Policy

All subscription payments are non-refundable, except in the limited circumstances described below. By completing a payment on our Platform, you acknowledge and agree that:

You are purchasing access to premium digital tools and services
You understand and accept the scope of the subscription prior to payment
Refunds are not granted for change of mind, unused subscriptions, or dissatisfaction with features

2. Refund Exceptions

c) Payment Methods

We accept secure payments via approved payment gateways (e.g., Paystack or SureCart). By subscribing, you authorize us to charge your selected payment method.

It is your responsibility to:

d) Downgrades & Upgrades

5. Marketplace, Shop, Returns & Refunds

The Collect::Grow::Show Marketplace allows approved users and sellers to list plants, seeds, propagation material, accessories, and other related products for sale through the Platform. Some products may be listed and sold directly by Collect::Grow::Show, while other products are listed and fulfilled by independent third-party sellers.

Because Marketplace products may be supplied by different sellers, return, refund, replacement, and cancellation terms may differ from seller to seller. Unless expressly stated otherwise on a specific product listing, Collect::Grow::Show does not control or guarantee the individual return or refund policies of third-party sellers.

a) Third-Party Seller Listings

For products listed by third-party sellers:

The seller is responsible for accurately describing the product, including its condition, size, quantity, availability, and any relevant shipping or handling information.
The seller is responsible for fulfilling the order and resolving legitimate order issues relating to their listing.
Any return, refund, replacement, or cancellation request must first be assessed according to the seller’s own stated terms, the product listing details, and any applicable consumer protection laws.
Collect::Grow::Show may, where appropriate, assist with communication between the buyer and seller, but does not automatically accept liability for refunds, returns, replacements, delivery delays, product condition, or seller-specific fulfilment issues.

Buyers are encouraged to review product photos, descriptions, seller information, shipping terms, and any seller-specific notes before completing a purchase.

b) CGS-Owned Product Listings

Where a product is listed and sold directly by Collect::Grow::Show, all sales are generally final. We do not offer returns or refunds for change of mind, buyer’s remorse, incorrect assumptions about the product, or where a plant or product does not meet a buyer’s personal expectation after delivery.

This is especially important for live plants and plant-related products, where appearance, size, growth form, colour, condition, and presentation may vary naturally. While we make reasonable efforts to describe and present products accurately, natural variation should be expected.

c) Order Problems and Incorrect Fulfilment

If there is a genuine problem with an order supplied directly by Collect::Grow::Show, such as the wrong product being shipped, a material fulfilment error, or another issue clearly caused by us, we will take reasonable steps to remedy the issue as soon as possible.

Depending on the circumstances, this may include:

reshipping the correct product at our cost;
replacing the affected item where stock is available;
offering an appropriate alternative remedy; or
considering a refund where no reasonable replacement or remedy is possible.

To help us assess the issue, buyers must contact us within a reasonable time after delivery and provide the order number, a clear description of the issue, and supporting photos where relevant.

d) Live Plants, Natural Variation, and Buyer Expectations

Live plants are natural products and may vary from listing photos due to growth, seasonal changes, lighting, shipping stress, handling, potting medium, or normal biological variation. A plant not matching a buyer’s subjective expectation does not automatically qualify for a return, refund, or replacement.

Collect::Grow::Show and Marketplace sellers will not be held responsible where:

the product supplied is substantially consistent with the listing;
the buyer expected a different size, colour, shape, growth form, or presentation not expressly guaranteed in the listing;
the plant changes condition after delivery due to environmental conditions, handling, care, repotting, acclimatisation, or neglect;
the buyer did not review the listing information before purchase; or
the issue arises from normal risks associated with transporting live plants.

e) Shipping, Courier, and Delivery Issues

Risk during shipping may depend on the specific seller, courier arrangement, delivery method, and product listing terms. Where a delivery issue occurs, buyers should notify the seller or Collect::Grow::Show as soon as possible and provide relevant photos, tracking details, and delivery information.

Where Collect::Grow::Show is the direct seller and the issue is clearly caused by our fulfilment error, we will take reasonable steps to assist. Where the issue relates to third-party seller fulfilment, courier handling, incorrect delivery details supplied by the buyer, or circumstances outside our control, the matter will be assessed on a case-by-case basis.

f) No Automatic Right to Return Marketplace Items

Except where required by applicable law, Marketplace and Shop purchases are not automatically refundable or returnable. Returns, refunds, replacements, or credits will only be considered where there is a genuine order issue, incorrect fulfilment, defective product, or another legally recognised basis for return.

This Marketplace and Shop returns policy does not limit any non-excludable rights a buyer may have under applicable consumer protection laws.

These Image Upload Terms apply to any image or related media you upload to Collect::Grow::Show (“CGS”, “we”, “us”, or “our”) through plant profiles, galleries, listings, community spaces, comments, submissions, or any other feature that allows user image uploads.

By uploading an image to CGS, you agree to these Terms.

If you do not agree with these Terms, please do not upload images to the Platform.

0. Definitions

For the purposes of these Image Upload Terms:

“Platform” refers to the Collect::Grow::Show website, database, tools, services, and all associated content.
“User” refers to any individual who accesses or uses the Platform.
“Uploaded Image” refers to any photo, image, graphic, or related visual file submitted by a user to the Platform.
“Content Metadata” refers to any category, credit, source, date, note, tag, or classification information submitted together with an uploaded image.
“Cloud Storage” refers to offsite digital storage infrastructure used to host and process uploaded files.

1. Purpose of Image Uploads

CGS is a plant-focused platform. Images uploaded to the Platform must be relevant to plants, plant collections, propagation, cultivation, identification, care, habitat, botanical reference, or closely related plant activities and discussions.

We reserve the right to remove images that are unrelated, misleading, off-topic, or inappropriate for the feature or section in which they are uploaded.

2. Your Responsibility for Uploaded Content

You are solely responsible for any image you upload and for any caption, tag, category, credit, comment, source information, or other metadata you provide with it.

By uploading an image, you confirm that:

You took the image yourself, or
You own the rights to upload it, or
You have the necessary permission or license to upload and use it on CGS.

Providing a credit line alone does not give you the right to upload an image if you do not otherwise have permission to use it.

3. Ownership of Uploaded Images

You retain ownership of the images you upload, subject to any rights you may already have granted to third parties.

Nothing in these Terms transfers ownership of your image to Collect::Grow::Show.

4. License Granted to CGS

By uploading an image to the Platform, you grant Collect::Grow::Show a non-exclusive, worldwide, royalty-free license to:

Host, store, copy, process, reproduce, format, resize, crop, orient, compress, optimize, and display the image;
Create thumbnails, previews, and derivative display versions for Platform functionality;
Use the image in connection with the operation, administration, moderation, support, security, backup, testing, and improvement of the Platform;
Associate the image with your plant records, profile content, or related Platform tools and features;
Retain limited technical, cached, or backup copies for reasonable operational, legal, or security purposes.

This license is granted only for the purpose of operating and supporting the Platform and does not transfer ownership of your image to us.

5. Storage and Processing of Uploaded Images

You understand and accept that uploaded images may be stored and processed using cloud-based or third-party infrastructure located offsite from the main website environment.

We take reasonable steps to operate the Platform responsibly, but we do not guarantee uninterrupted availability, permanent retention, or recovery of uploaded files.

CGS is not an archival or original-photo preservation service. Uploaded images may be resized, reoriented, compressed, converted, optimized, or otherwise processed for display, performance, storage efficiency, moderation, compatibility, or service improvement. The version displayed or stored by CGS may differ from the original file uploaded.

You should keep your own original copies and backups of any images you wish to preserve.

6. Classification and Accuracy of Information

You agree to classify and describe uploaded images as accurately as reasonably possible.

This may include, where applicable:

Image content category;
Image content type;
Source of the image;
Credit or photographer information;
Photo date;
Image comments or notes;
Whether the image is marked as featured or representative.

Accurate classification helps support search, filters, reporting, moderation, plant records, and future Platform functionality. Repeated careless, misleading, or false classification may be treated as misuse of the service.

7. Credits and Attribution

Where the upload feature allows or requires credit information, you agree to provide accurate attribution details.

If an image was taken by another person, you may upload it only where you have permission to do so and must provide attribution where required by the rights holder or license terms.

8. Prohibited Uploads

You may not upload any image or related content that:

Infringes copyright, trademark, privacy, publicity, moral rights, or any other rights of another person;
Is unlawful, fraudulent, defamatory, threatening, abusive, harassing, hateful, discriminatory, or deceptive;
Contains pornography, sexual exploitation, or sexualized content involving minors;
Contains graphic violence, cruelty, or material that we consider disturbing or unsafe for the Platform;
Promotes illegal activity or unlawful trade;
Contains malware, hidden code, harmful files, or attempts to disrupt the Platform;
Reveals personal, confidential, or sensitive information about another person without permission;
Is misleadingly labeled, impersonates another creator, or falsely claims ownership or permission;
Is unrelated to plants or to the intended purpose of the upload feature;
Is uploaded in a spam-like, abusive, excessive, or disruptive manner.

We may remove or restrict access to any such content at our discretion.

9. Moderation and Enforcement

We may review, moderate, refuse, remove, restrict, or disable access to any uploaded image at any time, with or without notice, where we reasonably believe it may violate these Terms, our broader site policies, applicable law, or the intended use of the Platform.

We may also suspend, restrict, or terminate accounts for misuse, repeated violations, abusive conduct, infringement complaints, or attempts to bypass Platform rules.

Serious or repeated abuse may result in:
